New rules for the use of social media and AI in Brazil in 2026
Brazil will raise the minimum age for using social media and messaging apps starting in 2026. The new legislation, which comes into effect on March 17th, stipulates that messaging apps should be recommended for users aged 12 and older, while social media will have a minimum age of 16. Interestingly, the age recommendation for artificial intelligence chatbots has been lowered to 13, following an evaluation by the Ministry of Justice and Public Security (MJSP). The measure aims to protect children and adolescents, obligating digital platforms to verify users' ages to prevent inappropriate interactions, in accordance with the new Digital Child and Adolescent Statute (ECA Digital), sanctioned in September by President Lula.
